Dutchess Duo Charged With Trespass, Larceny

Sheriff Donald B. Smith announces the recent arrest of a man and a woman from Dutchess County on charges of petit larceny and criminal trespass.

While patrolling Route 9 in the Town of Philipstown, Deputy Sheriff Randel Hill observed a motorist commit a traffic violation while exiting the parking lot of Laser Tech Fabricators, Inc., a business which was closed overnight. The deputy initiated a traffic stop and identified the occupants of the vehicle as Judith A. Stacker, 51, and John H. Gardner, 34, both of 111 Route 9, Fishkill.

The deputy’s investigation revealed that the two subjects had unlawfully entered a fenced enclosure at Laser Tech and had stolen a quantity of scrap metal from that business which they had placed in the rear of their pick up truck. The deputy arrested the pair and charged them with Criminal Trespass in the Third Degree and with Petit Larceny, misdemeanors. The defendants were processed at the Putnam County Correctional Facility and held pending arraignment.

If found guilty of the misdemeanor charges, the defendant could face up to a year in jail and a fine of up to $1,000.00 for each charge.
